Legally no, because Sky's license prohibits it. But using any version of the Spectrum ROM in a clone is illegal. It doesn't physically prevent people from doing it.

But what if it's actual physical ROM legally taken from dead ZX-Spectrum? ;)

Well if you have a real Spectrum you can use any ROM you like in it. And if you take a ROM from that machine you can use it in a clone (so long as you leave the Spectrum empty) but beyond that it's a gray area.
